1. Definitions

In these Terms and Conditions:

• "We", "Us", "Our" refers to Cloud Pagoda, a residential home for elderly persons located at 36 Lai King Hill Road, Kwai Chung, New Territories, Hong Kong.
• "You", "User" refers to any person who accesses our website or enquires about or engages with any of our programmes or services.
• "Service" refers to the residential, cultural, and introductory programmes offered by Cloud Pagoda.
• "Website" refers to the pages accessible at cloudpagoda.pro.
• "Resident" refers to an elderly individual placed in our care under the Pagoda Residence programme.

2. Acceptance of Terms

By using our website or contacting us about our programmes, you confirm that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree, please do not proceed with using our website or engaging our services. These Terms apply to all persons aged 18 or over. We do not contract with minors.

3. Description of Services

Cloud Pagoda operates a non-medical residential home for elderly persons in Kwai Chung, New Territories, Hong Kong. Our programmes include:

• Pagoda Residence: Full-time residential accommodation with meals, housekeeping, cultural activities, and 24-hour care companionship
• Chinese Arts Appreciation: A twice-weekly structured cultural programme open to residents and non-residents
• Five-Night Introduction: A five-night residential trial with full access to meals and activities, followed by a written family report

Cloud Pagoda does not provide medical, nursing, or clinical services. Residents requiring clinical care continue to engage their own medical practitioners.

4. Enquiries and No Obligation

Submitting an enquiry through our contact form or by telephone or email creates no binding obligation on either party. Engagement with our services is formalised only through a separate written agreement signed by both parties.

5. User Responsibilities

When using our website or engaging with our team, you agree to:

• Provide accurate and complete information in any enquiry or communication
• Use our website only for lawful purposes
• Not attempt to interfere with or disrupt the operation of our website
• Not submit false or misleading information
• Respect the privacy and dignity of our residents when visiting the home

6. Intellectual Property

All content on this website — including text, images, layout, and design — is the property of Cloud Pagoda or used with appropriate permission. You may not reproduce, distribute, or use any content from this website without our prior written consent. A limited, non-exclusive, non-transferable licence is granted solely for your personal, non-commercial use of the website.

7. Payment Terms

Fees for our programmes are as follows:

• Pagoda Residence: HK$15,600 per calendar month
• Chinese Arts Appreciation: HK$2,200 per calendar month
• Five-Night Introduction: HK$3,800 for five consecutive nights

Fees are payable in Hong Kong Dollars. Specific payment schedules, methods, and refund conditions are detailed in the individual written agreement for each programme. Cloud Pagoda reserves the right to review its fees from time to time. Any changes will be communicated in advance of the next billing period.

8. Service-Specific Terms

Placement in the Pagoda Residence programme requires completion of a written residency agreement. This agreement sets out the notice period for termination, the responsibilities of both parties, and arrangements relating to personal property and emergency contacts. Terms for the Chinese Arts Appreciation programme and the Five-Night Introduction are set out in the relevant enrolment documents provided at the time of registration.

9. Disclaimers

Our services are provided with care and professionalism. However, we make no specific claims regarding health outcomes, behavioural changes, or wellbeing improvements. Cloud Pagoda is not a medical provider. Information on this website is for general reference only and does not constitute medical, legal, or professional advice. You should seek independent advice as appropriate to your situation.

10. Limitation of Liability

To the fullest extent permitted under Hong Kong law, Cloud Pagoda's liability for any claim arising from use of this website or from our programmes shall not exceed the total fees paid to us in the three months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special losses. Nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, or for fraud.

11. Termination

Cloud Pagoda reserves the right to end or suspend any programme in circumstances where continued participation is not in the best interests of the resident or other persons at the home, or where there is a material breach of any agreement. The resident or their authorised representative may also terminate any programme arrangement in accordance with the notice period set out in the relevant written agreement.

12. Dispute Resolution

We hope that any concern can be resolved through direct communication with our team. If a formal dispute arises, it shall be subject to the laws of the Hong Kong Special Administrative Region. The parties agree to attempt informal resolution before resorting to formal legal proceedings. The courts of Hong Kong shall have exclusive jurisdiction over any unresolved dispute.

13. Changes to These Terms

We may update these Terms from time to time. Updated Terms will be published on this page with a revised effective date. Continued use of our website or services after any update constitutes acceptance of the revised Terms.
